These Terms and Conditions govern your engagement with Cogspring ("the Workshop", "we", "us", "our") for watch restoration and related services. By submitting an enquiry, delivering a timepiece to the workshop, or agreeing to a quotation, you accept these terms in full. Please read them before proceeding.

01Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- "Workshop" / "Cogspring" — the watchmaking workshop operated at Lot 8-3A, Lebuh Pantai, 10300 George Town, Penang, Malaysia.
- "Owner" / "You" — any individual or entity who delivers a timepiece to the Workshop or engages our services.
- "Services" — any watch restoration, servicing, conversion, or related work carried out by the Workshop.
- "Piece" / "Timepiece" — the watch or clock delivered to the Workshop for servicing.
- "Quotation" — a written estimate provided by the Workshop before work commences.
- "Agreement" — the binding arrangement formed when an Owner accepts a Quotation in writing.
02Acceptance of Terms
By delivering a timepiece to the Workshop or accepting a quotation (whether verbally, in writing, or by electronic communication), you confirm that:
- You are at least 18 years of age and have legal capacity to enter a binding agreement under Malaysian law.
- You have read and understood these Terms and Conditions.
- You are the lawful owner of the timepiece, or you have the authority to authorise work on behalf of the owner.
03Services Described
Cogspring offers the following services from its George Town, Penang workshop:
- Pocket Watch Bench Service — full disassembly, cleaning, mainspring evaluation, escapement regulation, and timing verification for hand-wound pocket watches.
- Wristwatch Conversion of Pocket Pieces — adaptation of a pocket watch movement into a wristwatch case, including movement service and owner-directed case selection.
- Dial Restoration & Lume Refresh — non-abrasive dial cleaning, owner-directed lume reapplication, hand straightening and reluming, and crystal replacement where required.
Services are available to customers in Malaysia. The Workshop does not commit to accepting every piece presented; feasibility is assessed on a case-by-case basis. The Workshop operates in English.
04Enquiries & Quotations
All enquiries are welcomed via the contact form at our website, by telephone, or in person at the workshop. Submission of an enquiry does not constitute an Agreement and does not oblige the Workshop to carry out any work.
Following inspection of the timepiece, the Workshop will provide a written Quotation setting out the proposed scope, estimated duration, and price. The Quotation is valid for 14 days from the date of issue. Work commences only after the Owner accepts the Quotation in writing.
Where the Workshop discovers additional work that was not foreseeable at the time of Quotation, it will contact the Owner before proceeding. Any change to scope or price requires written agreement from the Owner.
05User Responsibilities
As an Owner engaging the Workshop's services, you agree to:
- Provide accurate information about the timepiece, including known history, previous repairs, and any known faults.
- Respond to Workshop communications within a reasonable time (generally within 7 days) so that work may proceed without unnecessary delay.
- Collect your timepiece within 30 days of notification that it is ready. Pieces left beyond this period may incur a storage charge of RM 20 per week.
- Not deliver any timepiece that you do not have authority to have serviced or modified.
- Treat Workshop staff with courtesy. The Workshop reserves the right to decline service to anyone who behaves inappropriately.
06Intellectual Property
All content on the Cogspring website — including text, photographs, service records, and design — is the property of Cogspring and is protected under Malaysian copyright law and applicable international conventions. You may not reproduce, distribute, or use this content without written permission.
Photographs taken by the Workshop of your timepiece during the service process are used solely for the purpose of documenting the work. These photographs will not be published publicly without your written consent.
07Payment Terms
All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise. Current service prices are:
- Pocket Watch Bench Service — RM 990
- Wristwatch Conversion of Pocket Pieces — RM 2,790
- Dial Restoration & Lume Refresh — RM 1,420
Payment is due in full upon collection of the timepiece. The Workshop accepts cash and major bank transfers. The timepiece will not be released until full payment is received.
Refunds. If work is cancelled by the Owner before the Workshop has commenced bench work, no charge applies. Once bench work has begun, the Workshop will invoice for the proportion of work completed. Completed services are non-refundable except where the Workshop has demonstrably failed to carry out the agreed scope.
Parts replaced during service (worn mainsprings, crystals, jewels) are not returned unless specifically requested in writing before work begins.
08Service Scope & Changes
The Workshop will carry out the work described in the accepted Quotation. Where the condition of the piece, once open, reveals that additional or different work is necessary or advisable, the Workshop will contact the Owner with a revised assessment before proceeding.
The Owner may instruct the Workshop to stop at any point before irreversible work begins. Once an irreversible step has been approved by the Owner and carried out, that step cannot be undone and no refund will be issued for it.
Durations quoted (e.g. four weeks, eight to twelve weeks) are indicative. The Workshop will notify the Owner if a project is likely to take materially longer than estimated.
09Disclaimers
The Workshop carries out its work with care and skill, but watch movements are mechanical objects whose condition can be variable and sometimes unpredictable. The Workshop does not warrant that a serviced movement will achieve any specific rate accuracy beyond that indicated in the service record.
The Workshop is not responsible for pre-existing damage that is discovered only upon disassembly and that was not visible or foreseeable during the initial inspection. Where such damage is found, the Owner will be informed before any further action is taken.
Advice given by the Workshop regarding the condition, value, or history of a timepiece is offered in good faith based on the watchmaker's expertise but does not constitute a formal valuation or authentication for insurance, legal, or estate purposes.
10Limitation of Liability
To the fullest extent permitted by the Consumer Protection Act 1999 (Malaysia) and other applicable law, the Workshop's total liability to any Owner for any claim arising from the Services shall not exceed the total amount paid by that Owner for the specific service giving rise to the claim.
The Workshop shall not be liable for any indirect, consequential, or special loss, including loss of sentimental value, loss of anticipated timekeeping performance, or loss arising from the Owner's inability to use the timepiece during the service period.
Force majeure. The Workshop is not liable for delay or failure to perform caused by events outside its reasonable control, including natural disasters, civil disruption, or supply chain failure affecting parts availability.
11Indemnification
You agree to indemnify, defend, and hold harmless Cogspring and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your provision of inaccurate information about the timepiece, or your failure to collect the timepiece within the agreed timeframe.
12Termination
Either party may terminate the Agreement at any time before irreversible work has commenced, with written notice. Where the Owner terminates after the Workshop has commenced work, the Workshop will invoice for the proportion of work completed at its standard hourly bench rate.
If an Owner fails to collect a timepiece or respond to communications for a period exceeding 90 days after notification that work is complete, the Workshop may treat the Agreement as abandoned. In such cases, the Workshop may apply for a court order to recover outstanding fees from the value of the piece, in accordance with Malaysian law.
13Dispute Resolution
Governing law. These Terms are governed by the laws of Malaysia. Any disputes are subject to the exclusive jurisdiction of the courts of Penang, Malaysia.
Informal resolution. Before initiating any formal proceeding, both parties agree to attempt to resolve any dispute informally by contacting the Workshop at [email protected] and allowing 14 days for a response.
Consumer rights under the Consumer Protection Act 1999 and the Sale of Goods Act 1957 (Malaysia) are not affected by these Terms.
14General Provisions
- Entire Agreement. These Terms, together with any accepted Quotation, constitute the entire agreement between you and the Workshop with respect to the Services.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Waiver. Failure to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment. You may not assign your rights under these Terms without the Workshop's prior written consent. The Workshop may assign its rights in connection with a transfer of the business.
- Notices. Formal notices should be sent by email to [email protected] or by post to Lot 8-3A, Lebuh Pantai, 10300 George Town, Penang.
15Changes to These Terms
The Workshop may update these Terms from time to time. The revised version will be posted on the website with an updated "Last Updated" date. Changes take effect from the date of posting. Owners who have accepted a Quotation prior to the update date will be governed by the Terms in force at the time of acceptance.
Continued use of the Workshop's services after a revision constitutes acceptance of the revised Terms.
